RESOLUTION No. 006, S. 2019
RESOLUTION DECLARING THE APPLIED AREA OF GAMBANG, BAKUN, BENGUET AS PEOPLE’S SMALL SCALE MINING AREA OR MINAHANG BAYAN
WHEREAS, this Board is authorized to declare and set aside People’s Small-Scale Mining Areas as provided under Section 5 of R.A. No. 7076 “People’s Smallscale Mining Act of 1991″ and its Implementing Rules and Regulations;
WHEREAS, as an application for declaration of a Minahang Bayan covering an area of 287.00 hectares located in Sitios Bagtangan, Batanes and Goldstar, all are within Barangay Gambang, Bakun, Benguet was endorsed to the DENR Secretary for clearance and approval;
WHEREAS, the PMRB endorsed to the DENR Secretary thru Resolution No. 03, Series of 1997 during the PMRB meeting dated August 13, 1997 for the approval of the declaration of a Minahang Bayan in Bakun, Benguet;
WHEREAS, the Board received a Memorandum dated 20 June 2018 from Honorable Rodolfo C. Garcia, DENR Undersecretary giving a clearance to the applied area for declaration as People’s Small Scale Mining Area or Minahang Bayan subject to submission of Free and Prior Informed Consent from the NCIP and pursuant to the pertinent provisions of Department Administrative Order (DAO) No. 2015-03, the Revised Implementing Rules and Regulations of Republic Act No. 7076, the People’s Small-Scale Mining Act of 1991;
WHEREAS, finding the petition for the declaration of the People’s Small-Scale Mining Area or Minahang Bayan at Barangay Gambang, Bakun, Benguet was in order, the Board decided to give its approval;
NOW, THEREFORE, motion duly seconded, be it –
RESOLVED, that the applied area of Gambang, Bakun, Bengeut is hereby declared as People’s Small-Scale Mining Area or Minahang Bayan subject to submission of Free and Prior Informed Consent from the NCIP and pursuant to the pertinent provisions of Department Administrative Order (DAO) No. 2015-03, the Revised Implementing Rules and Regulations of Republic Act No. 7076, the People’s Small-Scale Mining Act of 1991;
RESOLVED, FURTHER, that this Declaration of People’s Small-Scale Mining Area or Minahang Bayan shall be published once in a local newspaper of general circulation;
RESOLVED FINALLY, that copies of this MB Declaration shall be furnished to the DENR Secretary, MGB Director, all concerned LGUs (Barangay, Municipal, and Provincial), and other Stakeholders, for their information.
