BAGUIO CITY – City officials recently authorized the local chief executive representing the local government to enter into memorandum of agreement or understanding and all similar agreements, provided that, they do not involve the sale, purchase or disposal of government properties, the disbursement of public funds and bind the local government into any monetary obligation and subject to review by the city council.
Under Resolution No. 721, series of 2024, local legislators agreed that there is a need to simplify the process of requesting for authority to sign such memoranda or similar agreements that do not involve any government properties or public funds and do not impose any monetary obligations to the city.
The council claimed that aware of Section 16 or the general welfare clause of Republic Act (RA) 7160 or the Local Government Code of 1991 that stated that every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare.
Further, the body claimed that cognizant that various transactions with companies, institutions, and organizations require the signature of the local chief executive on behalf of the local government through memorandum of agreement or understanding that do not involve the sale, purchase, or disposal of public properties, nor disburse public funds, nor bind the city into any monetary obligations.
The body stated that observing that in all of the aforesaid instances, the local chief executive will always secure authorization to sign the said agreements which usually take at least three weeks or more, causing delay in the signing of the said documents.
The council tasked the Office of the City Secretary to serve as the official repository of all final and duly notarized memorandum of agreement and understanding signed by the local chief executive in relation to the approved resolution. By Dexter A. See
