BAGUIO CITY – Existing locators, lessees, buyers and owners in the Camp John Hay Special Economic Zone are strongly enjoined to disregard malicious, false and misleading statements and press releases recently published by the John Hay Management Corporation (JHMC) informing the public that an alleged Court of Appeals (CA) decision has granted victory to Bases Conversion Development Authority (BCDA) against Camp John Hay Development Corporation (CJHDEVCO) in the pending dispute over Camp John Hay which supposedly has cleared the way for BCDA to take over the Camp, a senior official of the CJHDevCo said here.
Contrary to John Hay Management Corp.’s (JHMC’s) media releases, Alfredo Yñiguez, CJHDevCo executive vice president, pointed out the Court of Appeals upheld the right of CJHDEVCO to seek resolution of the dispute with BCDA through the arbitration proceedings which are still pending before the Philippine Dispute Resolution Center, Inc. (PDRCI).
“This ruling by the Court of Appeals upholding the arbitration process ends any adventurism by BCDA for a forceful take-over of the Camp unless BCDA is: granted a favorable ruling by the Arbitral Tribunal, and such ruling is confirmed by RTC of Baguio City and orders CJHDEVCO to turn-over the Camp to BCDA,” Yñiguez stressed.
He asserted to this date, there is no such ruling by the arbitral tribunal in favor of BCDA and there is no such confirmation of RTC Baguio City of an arbitral award in favor of BCDA and no final order for CJHDEVCO to turn-over the Camp to any party.
“Absent these, BCDA has absolutely no right to claim over Camp John Hay,” the CJHDevCo official added.
He emphasized these recent move of BCDA and JHMC which makes reference to the Court of Appeals ruling for BCDA to claim the Camp are mere desperate attempts by BCDA and JHMC to pre-judge the outcome of the pending arbitration case and influence the minds of the Arbitral Tribunal.
“We encourage our locators, lessees, buyers and owners in the Camp to join CJHDC in upholding the Rule of Law by disregarding these misleading attempts by JHMC /BCDA,” he said.
The CJHDevCo official reminded the locators that if they have received or receive any threats, misleading letters, statements and communications from BCDA or JHMC to directly transact with their offices, please immediately report and forward these correspondences to CJHDEVCO so that the proper legal redress may be provided.
Earlier, BCDA officials announced that CAMP John Hay’s operations will be fully in the hands of government again following the latest ruling of the Court of Appeals (CA) dissolving the writ of preliminary injunction issued by a Baguio-based Regional Trial Court (RTC) over the planned takeover of the former American rest and recreation center by the State-owned Bases Conversion and Development Authority (BCDA), a senior official said here.
The BCDA leadership is now reaching out to investors in preparation for a smooth transition of the return of Camp John Hay into their hands after the Camp John Hay Development Corporation (CJHDevCo), the private developer of the 247-hectare John Hay Special Economic Zone (JHSEZ) lost its case in the CA.
