TINOC, Ifugao – A master teacher of the Department of Education Tinoc district refuted the charges filed against her before the Office of the Ombudsman, saying that she vehemently and vigorously denied the baseless, sham and malicious accusations of the complainant and stand by her innocence on the charges.
In her 2-page counter-affidavit, Novilyn N. Basilio underscored that when she was employed with the Department of Education, she honestly filed her Statement of Assets and Liabilities and Net Worth (SALN) with the concerned agency for 2007, 2008 and 200i98 contrary to the allegation that she never filed the same as certified by the records officer of the Deputy Ombudsman for Northern Luzon that her SALN for the said years were not actually filed.
Basilio attached the photo copies of her SALN for the said years and that she was able to obtain the said copies from the agency’s division office located in Lagawe, Ifugao that formed part of her counter-affidavit.
Basilio prayed for the outright dismissal of the charges filed against her considering that she was able to file her questioned SALNs as per attached photo copies of the same.
Earlier, Salvador Liked filed administrative charges against Basilio for her alleged failure to file her SALN for the years 2007, 2008 and 2009 as certified by the records officer of the Deputy Ombudsman for Northern Luzon which is tantamount to violation of the pertinent provisions of Republic Act (RA) 3019 or the Anti-Graft and Corrupt Practices Act and RA 6713 or the Code of Conduct and Ethical Standards of Public Officials and Employees.
Liked said that the gathered pieces of evidence by the complainant and the pieces of evidence submitted by Basilio will be appreciated by the Ombudsman considering that there are some questionable entries in the questioned SALNs that will be appreciated by the investigators who will be assigned to look into the veracity of the records of the case.
Last November 18, 2017, the Ombudsman ordered Basilio to file her counter-affidavit on the charges of conduct prejudicial to the best interest of the service and misconduct that were filed against her by Liked and that she was given ten days to submit her reply to the said office.
Section of RA 3019 provides that every public officer and within the month of January of every other year thereafter as well as upon the expiration of his ir her term of office, or upon his resignation or separation from office, shall prepare and file with the office of the corresponding department head, or in the case of head department or chief of an independent office with the Office of the President or in the case of members of Congress and the officials and employees thereof, with the office of the Secretary of the corresponding House, a true detailed and sworn statement of assets and liabilities, including the statement of the amounts and source of his or her income, the amount of his personal and family expenses and amount of income taxes paid for the next preceding calendar year: provided, that public officers assuming office less than two months before the end of the calendar year, may file their statements in the following months of January
On May 29, 2017, the records officer of the Deputy Ombudsman for Northern Luzon certified that Basilio did not file her SALN for the years 2007, 2008 and 2009.
