BAGUIO CITY – The City Council adopted an ordinance setting new guidelines for the operation of “non-motorized wheeled vehicle” rental concessions at Burnham Park.
Ordinance No. 77-18 tagged as the “Burnham Park Non-Motorized Wheeled Vehicle rental Ordinance amended Ordinance No. 243-56 which regulates and fixes the rates of the operation of recreation vehicles at the park.
It also fortified Administrative Order 045-2014 issued by Mayor Mauricio Domogan which set the rules and regulations on the bicycle operation providing for the regulation and control, business decorum, general policy, business hours and charges, and implementation and enforcement of the said business.
Authored by Vice-Mayor Edison R. Bilog and Couns. Leandro Yangot Jr., Edgar Avila, Joel Alangsab, Elmer Datuin, Benny Bomogao and Francisco Ortega VI., the measure which was ratified by Domogan last week covers those operating Go Karts, BMX, tri-bikes, choppers, Mt. Bikes, Junior Mt. Bikes, Gran Family Tours and others.
Under the ordinance, the concessionaires will be required to follow the regular licensing processes and will be under the supervision of the City Environment and Parks Management Office (CEPMO).
They will not rent out facilities to children below 12 years unless accompanied by parents or guardians, will not also rent out such during school days unless the students are accompanied by parents or guardians and will not allow racing, persons under the influence of liquor, gambling, urinating, defecating, spitting, massage, nail services and other unauthorized activities.
There should be no leasing or subleasing, expansion of allocated area, constructions and adding other lines of business.
They are required to maintain business decorum, sanitation and vicinity make-up with their workers having proper identification cards and uniforms and police clearances submitted to CEPMO.
The NMWV operating hours is from 6 a.m. to 10 p.m. but during summer, it may be extended up to 12 midnight.
The maximum rental rate of NMWVs for adult customers are: Go Kart (3 or 4-wheeler) — ₱100 per hour; Tri-Bike/Chopper — ₱ 80/ hour; Mt. Bike and Junior Mt. Bike –₱ 50/hour.
The maximum rental rate kiddie customers are: Pedal Go Kart (3 or 4-wheeler) — ₱ 50/30 minutes and ₱100/ hour; Tri-Bike/Chopper Go Kart — ₱ 75 /30 minutes and ₱150/hour; Mt. Bike – ₱50/hour; Gran Family Tour – ₱125/30 minutes.
To minimize accidents, separate NMWV lanes for adult and kiddie customers shall be set and established: the NMWV lane shall be exclusively for adults while Jose Abad Santos Street shall be for kids; and
The premises assigned both for adult and kiddie NMWVs are subject to possible site relocations within the park reservation and as deemed necessary by the City Government of Baguio without prior notice.
Every adult NMWV concessionaire is allowed a maximum of five Go Kart units and 12 NMWV units of standard two-wheeler, three-wheeler and four-wheeler for rent in a day while every kiddie NMWV concessionaire is allowed a maximum of 32 Go Kart units either three-wheeler or four-wheeler for rent in a day.
No fabrication of NMWV frames (any size frame) to smaller frame to suit kiddie riders or vice versa will be allowed and any excess unit found during periodic inspection or reported to CEPMO shall be automatically subjected to confiscation by the inspection team (as created under Section 13) and the unit shall be kept at the Burnham Park Office until such time that it will be redeemed by the operator after payment of P10,000 per unit.
Any concessionaire found violating the ordinance shall be issued a warning for the first offense and slapped fines ranging from P2.500 to P5,000 with cancellation of business permit for the succeeding offenses.
The CEPMO in coordination with the Baguio City Police Office (BCPO) and the security agency personnel will enforce the regulations. – Aileen P. Refuerzo
