Ikinatuwa ni dating Speaker Alan Peter Cayetano ang pagluluwag ng Saudi Arabia sa kanilang “kafala system” dahil libo-libong mga Overseas Filipino Workers (OFWs) ang makikinabang dito.

Sa ilalim ng “kafala”, nagmimistulang pag-aari ng mga employer ang mga migranteng manggagawa. Dahil mayroong absolute control ang mga employer sa mga OFW, hindi basta basta makakaalis ng bansa o makakalipat ng trabaho ang mga empleyado kahit tapos na ang kanilang kontrata ng walang pahintulot ng kanilang mga amo.

Ang “kafala” system na umiiral sa Middle East ang siyang nagpapahirap sa mga OFWs na nagtatrabaho doon. Pinaniniwalaang ang sistemang ito ang ugat ng maraming kaso ng pang-aabuso at pag-mamaltrato sa marami nating mga kababayang nagtatrabaho bilang kasambahay.

Dahil sa mga reporma sa labor policies, magkakaroon na ng kalayaan ang mga OFW na makalabas ng Saudi Arabia, makalipat ng trabaho kahit walang pahintulot ng kanilang amo. Hindi na rin maaaring itago ang kanilang mga personal na pag-aari tulad ng cellphone at passport.

Ayon kay Cayetano, malaking hakbang ito para sa pagsusulong ng patas na karapatan at proteksyon ng mga OFWs. Gayunman sinabi nito na hindi pa tapos ang laban at kailangan itong bantayan ng mabuti para masiguro ang kaligtasan ng mga OFWs lalo ang mga “household service workers” na karaniwang nagiging biktima ng pag-aabuso.

Nagsimula ang kampanya ng Pilipinas laban sa kafala noong si Cayetano pa ang Kalihim ng Department of Foreign Affairs (DFA). Sa pagtutulungan ng Bahrain at Pilipinas para isulong ang pantay ng proteksyon laban sa pang-aabuso, mabilis na naaprubahan ang Global Compact for Migration sa United Nations noong 2018.  Ito ang kauna-unahang United Nations Global Agreement na tutugon sa iba’t ibang pangangailangan at karapatan ng mga migrante sa buong mundo.

Kaugnay nito nanawagan si Cayetano sa agarang pagsasabatas ng Department of Overseas Filipinos and Foreign Employment para matugunan ng husto ang pangangailangan ng mga OFWs. Ang panukala ay pasado na sa Kamara noong isang taon ngunit nakabinbin pa din sa Senado. ###
