BAGUIO CITY – The City Council approved on third and final reading a proposed ordinance designating Immaculate Conception St. within South Central Aurora Hill Barangay as no parking zone.
The ordinance authored by all members of the city legislative body states the parking of motor vehicles along Immaculate Concepcion St. within South Central Aurora Hill Barangay shall not be allowed at all times and that the said road will be designated as towing zone.
Under the pertinent provisions of the proposed ordinance, violation of the same shall be treated as illegal parking and motor vehicles may be towed pursuant to the provisions of related ordinances that have been enacted in the past.
The ordinance tasked the deputized barangay officials or personnel under the anti-obstruction and traffic enforcement unit shall implement the provisions of the approved measure.
Further, the City Engineering office shall install the appropriate signages which shall bear appropriate information and the enacted measure governing the aforesaid prohibition.
Earlier, the barangay council of South-Central Aurora Hill enacted Ordinance No. 18-001, series of 2018 entitled ‘An Ordinance Designating Immaculate Concepcion St., South Central Aurora Hill Barangay as No Parking Zone.’
However, the ordinance stipulates that the matter is beyond the jurisdiction of the barangay council to legislative considering that Immaculate Conception St. is a city road, thus, the matter falls within the jurisdiction of the city council.
Section 458 of Republic Act (RA) 7160 or the Local Government Code of the Philippines provides that only the Sangguniang Panlungsod has the power to regulates traffic flow on all streets and bridges; prohibit encroachments or obstacles thereon and when necessary in the interest of public welfare, authorize the removal of encroachments and illegal constructions in public places.
The ordinance notes the latest action of the city legislative body on the aforesaid matter should serve as an eye-opener for the different barangays in the city to reconsider their positions in the designation of roads and streets in their areas as no-parking zones considering the status of the said roads.
The designation of no-parking zones in the different barangays of the city is pursuant to the efforts of the city government to prevent the unscrupulous parking of motor vehicles on roads that tend to constrict the smooth flow of traffic in the said areas, especially during nighttime.
Previously, the city government embarked on an aggressive anti-road obstruction campaign that resulted to the confiscation of license plate numbers of illegally parked motor vehicles in the different roads, not only in barangay roads, but also in city and national roads through the years.
The ordinance was referred by the members of the city legislative body to the appropriate committee for study and recommendation.
