Ano nga ba ang mga ligal na obligasyon ng employers?

Noong nakaraang linggo, pinag-usapan natin ang tungkol sa ginanap na RACE o Run After Contribution Evaders Campaign kung saan nag-issue ang SSS ng Show Cause Orders sa mga delingkwenteng employers sa San Fernando, La Union at Tuguegarao, Cagayan.

Ang tanong ng maraming employers natin ngayon ay kung ano nga ba talaga ang kanilang obligasyon sa SSS? May ilan kasi sa kanila na gustong maging responsable at masunurin sa batas subalit salat sa kaalaman kung ano at paano sila susunod dito.

Unang una, sino ba ang matatawag na employer? Batay sa Section 8-c ng RA 11199 o Social Security Act of 2018, ang mga employer ay “any person, natural or juridical, domestic or foreign, who carries on in the Philippines any trade, business, industry, undertaking or activity of any kind and uses the services of another person who is under his orders as regards the employment, except the Government and any of its political subdivisions, branches or instrumentalities, including corporations owned or controlled by the Government: Provided, That a self-employed person shall be both employee and employer at the same time”. Sa madaling salita, ang mga employers ay sinumang may mga tauhan o empleyado na pinasasahod o pinasusweldo kapalit ang kanilang serbisyo. Upang maiwasang maging delingkwente, narito ang mga sumusunod na obligasyon ng mga employers:

Una, i-rehistro sa SSS ang kanilang kumpanya, negosyo o serbisyo at kumuha ng employer ID Number sa pamamagitan ng pag-accomplish ng Employer Registration Form o SS Form R-1. Pangalawa, obligahin ang magiging empleyado  na magrehistro sa SSS at kumuha ng  Social Security (SS) Number. Pangatlo, i-report sa SSS ang lahat ng kanilang empleyado sa loob ng 30 araw mula sa aktwal na employment date sa pamamagitan ng pagsumite ng SS Form R1-A.

Pang-apat, ibawas sa sahod ng kanilang mga empleyado ang buwanang kontribusyon  at i-remit ito sa SSS branch na nakakasakop sa kanilang kumpanya o sa anumang SSS-accredited payment facility kasama ang bahagi ng hulog na manggagaling sa kanila bilang employer kasama ang kontribusyon para sa Employees’ Compensation.  Sa bagong SS Law, ang total monthly contribution ng empleyado ngayong taong 2019 hanggang 2020 ay magmumula sa employer share na 8% at employee share na 4%. Ang mga nasabing porsyento ay nakabase pa rin sa Monthly Salary Credit ng empleyado.

Panlimang obligasyon ng employer ay ibawas mula sa sahod ng empleyado ang buwanang loan amortization bilang pambayad sa pagkaka-utang ng miyembro sa SSS. Dapat din nila itong i-remit sa SSS branch na nakakasakop sa kanilang kumpanya o sa anumang SSS-accredited payment facility. Kinakailangan din i-submit ng employer sa SSS ang buwanang report ng employees’ loan amortization sa pamamagitan ng Member Loan Billing Statements.

Pang-anim, at isa sa madalas na nakakaligtaan ng mga employers, dapat nilang bayaran nang advance sa kanilang mga empleyado ang SS at EC sickness pati na rin ang maternity benefit na batay sa naaprubahang sickness at maternity notification ng SSS. Matapos i-advance ang pagbayad sa mga empleyado, ipa-file ng employer ang kanyang reimbursement sa SSS. Siguraduhing nakarehistro ang kanilang bank account sa Sickness and Maternity Benefits Payment thru the Bank Program upang direktang maideposito ng SSS ang reimbursement sa kanilang bank accounts.

Panghuli, ipaalam sa SSS ang anmumang pagbabago sa kanilang data o records, maging ang pansamantala o tuluyang pagsasara ng kumpanya.

Sa susunod nating kolum ay pag-usapan naman natin ang parusa at civil liabilities ng mga employer na hindi sumusunod sa kanilang obligasyon at kung anong mga hakbang ang maaaring gawin ng mga employers upang maiwasan na masampahan sila ng kaso ng SSS. Abangan!

Paalala sa lahat ng delingkwenteng employers at mga household employers! Matatapos na sa September 6, 2019 ang Contribution Penalty Condonation Program.  Huwag na sana pakawalan ang pagkakataong ito na bayaran ang mga hindi nabayarang kontribusyon ng kanilang mga empleyado, nang hindi kasama ang naipong multa. Kailangan ninyo lamang magsadya sa SSS branch na nakakasakop sa inyong kumpanya at magsubmit ng Letter of Intent. May option kayong bayaran ito ng isang bagsakan o installment basis. Kung babayaran ninyo nang installment, magsubmit lamang ng payment proposal. Kung nais ninyo naman bayaran nang buo, pumunta lamang sa SSS Tellering Facilities at iba pang SSS-accredited payment partners.

Patuloy pa rin ang Pension Loan Program. Para sa panandaliang pangangailangang pinansyal ng ating mga retiree pensioners, mag-apply na ng PLP sa pinakamalapit na tanggapan ng SSS sa kanilang lugar.

Good news para sa ating mga miyembro sa Benguet. Noong August 16, Biyernes, ay binuksan na ang SSS La Trinidad Branch. Matatagpuan ito sa Ground Floor Jewel Igorot Bldg., KM 4, Balili, La Trinidad Benguet. Sakop ng SSS La Trinidad branch ang mga bayan ng La Trinidad, Atok, Kapangan, Kabayan, Kibungan, Bokod, at Tublay. Tatanggap ang sangay na ito ng benefit claims, salary loan applications, pagbibigay ng SS Number, employer registration, at very soon ay maaari nang tumanggap ng UMID application.

Ang SSS La Trinidad ay ang ika-310th sangay ng SSS sa buong bansa at ika-walong branch sa ilalim ng Luzon North 1 Division. Bukas ito tuwing Lunes hanggang Biyernes, mula alas-otso ng umaga hanggang alas-singko ng hapon. Congratulations kay SSS Baguio Assistant Branch Head Don Malatag na siyang tatayo bilang OIC Branch Head  ng SSS La Trinidad.

Patuloy po na tumutok sa ating mga programa sa radyo. Ang “Usapang SSS” ay mapapakinggan tuwing Martes, alas-dyes ng umaga sa DZWT 745 khz at tuwing Biyernes naman alas-nuwebe ng umaga sa Z-Radio 98.7 FM. Sa mga mahilig naman sa Facebook, ang “Usapang SSS” Live FB ay mapapanood tuwing Biyernes, alas dyes ng umaga.
