The Occupational Safety and Health Standards (OSHS) is the primary regulatory framework in the Philippines that governs construction safety. These standards are set by the DOLE and cover various aspects of workplace safety and health.
The OSHC is the attached agency of DOLE that plays a key role in promoting and enhancing occupational safety and health in the Philippines. They provide technical assistance and support to DOLE inspectors and work towards the improvement of safety conditions in various industries, including construction.
Meanwhile, the Bureau of Working Conditions under the DOLE is primarily responsible for ensuring compliance with occupational safety and health standards in the workplace.
The Department employs labor inspectors who are vested with authority to conduct regular inspections to monitor, enforce the standards, and ensure compliance with labor laws, safety standards, and other regulations.
The DOLE inspectors follow a systematic process during inspections, which typically involves assessing the workplace, reviewing safety documentation, interviewing workers and management, and identifying potential hazards.
The inspectors have the authority to issue citations and recommend corrective measures for non-compliance with pertinent labor laws and safety and health standards.
DOLE inspectors may collaborate with other government agencies, such as the local government units and the Department of Public Works and Highways, to ensure comprehensive inspections and adherence to safety standards.
Additionally, Inspectors handle complaints and reports from workers or the public regarding labor and employment concerns, or safety violations in the workplace. Complaints may initiate investigations, and appropriate actions are taken based on the findings.
The DOLE is keen on promoting awareness campaigns, seminars, and training sessions to educate employers, workers, and the public about labor laws, rights, and responsibilities in order to promote voluntary compliance and prevent the occurrence of violations.
DOLE’s inspection program plays a crucial role in enforcing labor laws, protecting workers’ rights, and promoting safe and healthy working conditions across various industries, including construction. By conducting inspections, addressing violations, and raising awareness, DOLE contributes to the improvement of labor standards and the overall welfare of workers in the Philippines.
