Legal obligations ng mga employers sa SSS

Isa sa pinakamagandang programa na ipinapatupad ng Social Security System (SSS) sa kasalukuyan ay ang Run After Contribution Evaders (RACE) at ang Oplan Tokhang kung saan hinahabol ng SSS ang pag-aresto sa mga delingkwenteng employers na lumalabag sa Republic Act 11199 o Social Security Act of 2018.  Dito sa kampanyang ito ay nagbibigay tayo ng warrant of arrest sa mga may-ari ng mga negosyo kung saan kabalikat natin ang puwersa mula sa Philippine National Police (PNP).

Noong nakaraang linggo, tatlong (3) employers mula  sa Baguio City ang ating pinuntahan upang ma-isyuhan ng warrant of arrest sa mga kadahilanan tulad ng mga sumusunod: 1. Hindi pag-remit ng mga kontribusyon at loan payments sa SSS ng kanilang mga empleyado; o kaya’y 2. Hindi pag-report ng  kanilang mga empleyado sa SSS. Kasama rin dito ang malimit nating natatanggap na mga reklamo mula sa mga miyembro na hindi ipinapasa ang mga required na dokumento na hinihingi ng SSS sa mga employer at ang hindi pagbibigay ng anumang katibayan tulad ng payslip o kopya ng mga collection list bilang katunayan sa ginawa nilang pagbabayad ng kontribusyon sa SSS.

Hindi man naaresto ang mga employers na ito, hindi pa rin sila ligtas sa kanilang pananagutan sa batas. Kaakibat pa nito ang kaukulang kaso na ihahain sa kanila sa korte na may kaparusahan na  pagkakakulong ng anim (6) na taon at isang araw na pinalawig hanggang 12 taon at kabayaran ng multang umaabot sa P5,000 hanggang P20,000. Bukod pa rito ang  2% penalty kada buwan na sisingilin sa kanila sa bawat delayed contributions na hindi nila nabayaran. Sa ilalim ng lumang batas ng SSS o RA 8282, bago ang March 5, 2019, may pataw na 3% sa bawat buwan na may delayed payment sa kanilang mga kontribusyon.

Sino nga ba ang mga employers at anu-ano ang kanilang mga tungkulin at responsibilidad sa SSS?

Batay sa Section 8-c ng RA 11199 o Social Security Act of 2018, ang mga employer ay “any person, natural or juridical, domestic or foreign, who carries on in the Philippines any trade, business, industry, undertaking or activity of any kind and uses the services of another person who is under his orders as regards the employment, except the Government and any of its political subdivisions, branches or instrumentalities, including corporations owned or controlled by the Government: Provided, That a self-employed person shall be both employee and employer at the same time”. Tinutukoy rito ay ang mga employers ay sinumang nagbibigay sahod o suweldo sa kanilang mga tauhan o empleyado na nagbibigay ng kanilang serbisyo. Tandaan natin na kabilang sa kategoryang ito ang mga household owners na may mga kasambahay o househelpers sa kani-kanilang mga tahanan.

Una, kinakailangang i-rehistro ng employer sa SSS ang kanilang kumpanya, negosyo o serbisyo at kumuha ng employer ID Number sa pamamagitan ng pag-fill-out ng SSS Form R-1 o Employer Registration Form. Pangalawa, kailangang kumuha ng Social Security (SS) number ang kanilang mga empleyado. Pangatlo, dapat ay ini-re-report nila sa SSS ang kanilang mga empleyado sa unang araw ng kanilang pagtatrabaho sa kumpanya at binibigyan sila ng hanggang 30 araw para i-report ang mga ito sa SSS sa pamamagitan ng SS Form R1-A o Report of New Employees. Pang-apat, kailangang ibawas sa sahod ng kanilang mga empleyado ang buwanang kontribusyon ng mga ito at i-remit sa SSS branch na nakakasakop sa kanilang kumpanya o sa alinmang SSS-accredited payment facility. Simula Abril 2019, ang bahagi ng hatian ay 8% para sa employer at 4% naman sa mga empleyado kung saan nagpatupad ang SSS ng 1% contribution rate mula sa dating 11%. Ito naman ay nakabase sa monthly salary credit ng empleyado. Panglima, kung mayroong loan ang empleyado, kinakailangan ng employer na ibawas ito mula sa sahod ng empleyado bilang pambayad sa pagkaka-utang ng miyembro sa SSS. Dapat din nila itong i-remit sa SSS branch na nakakasakop sa kanilang kumpanya o sa alinmang SSS-accredited payment facility. Simula November 11, 2019 ay nagpatupad naman ang SSS ng Real-Time Processing of Loans (RTPL) kung saan required ang lahat ng employers na magrehisto sa My.SSS Facility upang makita ang kaukulang monthly billing statements via on-line bilang batayan ng kanilang pagbabayad sa SSS.

Pang-anim, dapat nilang bayaran nang advance sa kanilang mga empleyado ang Sickness at Maternity Benefits ng kanilang mga empleyado na hanggang ngayon ay marami pa ring employer ang lumalabag. Noong 2015 ay naging madali na ang pagbabayad ng SSS sa mga employers sa pamamagitan ng Sickness and Maternity Benefits Payment thru the Bank Program upang direktang maideposito ng SSS ang mga reimbursements sa kanilang bank accounts. Panghuli at pinakamahalang tungkulin ay  ipaalam sa SSS ang anumang pagbabago sa kanilang data o records, maging ang pansamantala o tuluyang pagsasara ng kumpanya kung ito’y nagpalit na ng may-ari o ‘di kaya’y ang paglipat ng lokasyon.

Bilang mga employers, hindi rin dapat nililimutan ang pagbabayad ng EC contributions ng kanilang mga empleyado na nagkakahalaga mula P10-P30 kada buwan bilang proteksyon sa anumang aksidente o sakuna na maaaring mangyari sa mga ito habang  nagtatatrabaho.  kumpanya. Ito naman ay benepisyong matatanggap mula sa Employee’s Compensation Commission (ECC).

Bukas pa rin ang SSS sa pagtanggap ng aplikasyon para sa Enhanced Pension Loan Program (PLP) para sa ating mga retiree pensioners. Makakahiram na po kayo hanggang P200,000 bilang maximum loanable amount na maaaring bayaran hanggang 24 months o dalawang (2) taon. Magsadya lamang sa pinakamalapit na SSS branch sa inyong lugar para sa inyong mga aplikasyon.
