LA TRINIDAD, Benguet – The Regional Trial Court (RTC) Branch 63 dismissed the estafa and illegal recruitment charges that were filed by two victims against the suspect due to the alleged lack of interest among the private complainants to prosecute the case and in recognition of the right of the suspect to a speedy trial.
Judge Jennifer Humiding acted on the motion of the counsel for the accused Anjo Sacley for the dismissal of the estafa and illegal recruitment cases that were filed against her considering that the private complainants in the said cases failed to appear before the court several times even with the issuance of the mandatory subpoena that indicates that they are not interested to pursue the case against him.
The court stated that the prosecution was not able to present any witness so far in the two cases that were filed against the suspect Sacley.
The court noted that the subpoenas for the private complainants to appear during the two previous hearings were received by the complainant failed to appear, thus, his absence was deemed lack of interest to prosecute the said cases.
